A state Assemblyman from Harlem was charged with drunken driving early Tuesday morning near Exit 5 on the Northway, town police said.

Robert Rodriguez, a Democrat who represents the 68th District in East Harlem, was pulled over at 2:10 a.m. in his 1998 Jeep Grand Cherokee, according to his arrest report.

Rodriguez, 37, had alcohol on his breath and "displayed watery, bloodshot eyes and slow speech," according to the report.

Police said Rodriguez never identified himself as an Assemblyman and instead told cops he is the vice president of A.C. Advisory, a New York City-based financial firm.

The lawmaker failed a field sobriety test and then refused to submit to a chemical test, police said.

Rodriguez was charged with driving while intoxicated, refusing to submit to a chemical test and ticketed for failing to keep right. He was issued an appearance ticket and released.
